These terms and conditions (collectively, “Terms”) govern your use of Canine Revolution Dog Training (collectively, “Canine Revolution”, “we”, “us”, and “our”) websites, mobile properties, and and all other interactive features and communications we provide in connection with the website, however accessed or used, that we operate, make available, produce, or maintain (collectively, the “Service”). We offer this website, including all information, tools, and services available from this site to you (the “User”) conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

These Terms of Service are a legally binding contract between you and Canine Revolution regarding your use of the Service.

BY CLICKING “I ACCEPT” OR BY OTHERWISE ACCESSING OR USING THE SERVICE, YOU AGREE THAT YOU HAVE READ AND UNDERSTOOD, AND, AS A CONDITION TO YOUR USE OF THE SERVICE, YOU AGREE TO BE BOUND BY, THE FOLLOWING TERMS AND CONDITIONS, INCLUDING CANINE REVOLUTION’S PRIVACY POLICY (TOGETHER, THESE “TERMS”). IF YOU ARE NOT ELIGIBLE OR DO NOT AGREE TO THE TERMS, THEN YOU DO NOT HAVE OUR PERMISSION TO USE THE SERVICE. YOUR USE OF THE SERVICE, AND CANINE REVOLUTION’S PROVISION OF THE SERVICE TO YOU, CONSTITUTES AN AGREEMENT BY CANINE REVOLUTION AND BY YOU TO BE BOUND BY THESE TERMS.

SECTION 1. ONLINE STORE TERMS

These terms and conditions (collectively, “Terms”) govern your use of Canine Revolution Dog Training (collectively, “Canine Revolution”, “we”, “us”, and “our”) websites, mobile properties, and and all other interactive features and communications we provide in connection with the website, however accessed or used, that we operate, make available, produce, or maintain (collectively, the “Service”). We offer this website, including all information, tools, and services available from this site to you (the “User”) conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

IF YOU ARE NOT ELIGIBLE OR DO NOT AGREE TO THE TERMS, THEN YOU DO NOT HAVE OUR PERMISSION TO USE THE SERVICE. YOUR USE OF THE SERVICE, AND CANINE REVOLUTION’S PROVISION OF THE SERVICE TO YOU, CONSTITUTES AN AGREEMENT BY CANINE REVOLUTION AND BY YOU TO BE BOUND BY THESE TERMS.

SECTION 2. GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

SECTION 3. LIMITED LICENSE GRANT TO CANINE REVOLUTION

By providing User Content to or via the Service, you grant Canine Revolution a worldwide, non-exclusive, royalty-free, fully paid right and license (with the right to sublicense) to host, store, transfer, display, perform, reproduce, modify for the purpose of formatting for display, and distribute your User Content, in whole or in part, in any media formats and through any media channels now known or hereafter developed.

SECTION 4. COMMUNICATIONS

Text messaging. Canine Revolution and those acting on our behalf may send you text (SMS) messages at the phone number you provide us. By using our Service you acknowledge your understanding and agreement that:

a. these messages may include operational messages about your use of the Service, as well as marketing messages and collections messages.

b. you may opt out of receiving marketing, collections, and/or operational text messages at any time by sending an email to info@caninerevolutiondogtraining.com indicating that you no longer wish to receive such texts along with the phone number of the mobile device receiving the texts OR BY texting “STOP” from the mobile device receiving the messages. You may continue to receive text messages for a short period while Canine Revolution processes your request, and you may also receive text messages confirming the receipt of your opt-out request.

c. text messages may be sent using an automatic telephone dialing system.

d. your agreement to receive text messages is not a condition of any purchase or use of the Service.

e. standard data and message rates may apply whenever you send or receive such messages, as specified by your carrier. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

Email. We may send you emails concerning our products and services, as well as those of third parties. You may opt out of promotional emails by following the unsubscribe instructions in the promotional email itself.

Phone calls. Canine Revolution and those acting on behalf may call you at the phone number you provide us.  By using our Service, you expressly consent to receiving operational, collections, and other calls, including auto-dialed and pre-recorded calls from us, our marketing partners, our agents, and others calling at their request or on their behalf at any telephone number that you have provided or will provide in the future (including any cellular telephone numbers).  Standard rates may apply as specified by your carrier.  If you have any questions about your rates, it is best to contact your carrier.  You may opt out of receiving marketing or other calls by sending an email to info@caninerevolutiondogtraining.com indicating that you no longer wish to receive calls at that number. You may continue to receive calls while we verify and process your request.

SECTION 5. PROHIBITED CONDUCT

BY USING THE SERVICE YOU AGREE NOT TO:
a. use the Service for any illegal purpose or in violation of any local, state, national, or international law;

b. violate, or encourage others to violate, any right of a third party, including by infringing or misappropriating any third party intellectual property right;

c. interfere with security-related features of the Service, including by: (i) disabling or circumventing features that prevent or limit use or copying of any content; or (ii) reverse engineering or otherwise attempting to discover the source code of any portion of the Service except to the extent that the activity is expressly permitted by applicable law;

d. interfere with the operation of the Service or any user’s enjoyment of the Service, including by: (i) uploading or otherwise disseminating any virus, adware, spyware, worm, or other malicious code; (ii) making any unsolicited offer or advertisement to another user of the Service; (iii) collecting personal information about another user or third party without consent; or (iv) interfering with or disrupting any network, equipment, or server connected to or used to provide the Service;

e. perform any fraudulent activity including impersonating any person or entity, claiming a false affiliation, accessing any other Service account without permission, or falsifying your age or date of birth,

SECTION 6. MODIFICATION OF THESE TERMS

We reserve the right to change these Terms on a going-forward basis at any time. Please check these Terms periodically for changes. If a change to these Terms materially modifies your rights or obligations, we may require that you accept the modified Terms in order to continue to use the Service. Material modifications are effective upon your acceptance of the modified Terms. Immaterial modifications are effective upon publication. Disputes arising under these Terms will be resolved in accordance with the version of these Terms that was in effect at the time the dispute arose.

SECTION 7. TERM, TERMINATION

Term. These Terms are effective beginning when you accept the Terms or first access, or use the Service, and ending when terminated as described below.

These Terms , (including, for clarity, the Additional Terms and any other agreements expressly incorporated by reference into these Terms), are the entire and exclusive understanding and agreement between you and Canine Revolution regarding your use of the Service. Use of section headers in these Terms is for convenience only and will not have any impact on the interpretation of any provision. Throughout these Terms the use of the word “including” means “including but not limited to”. If any part of these Terms is held to be invalid or unenforceable, the unenforceable part will be given effect to the greatest extent possible, and the remaining parts will remain in full force and effect.

You may not assign or transfer these Terms or your rights under these Terms, in whole or in part, by operation of law or otherwise, without our prior written consent. We may assign these Terms at any time without notice or consent.

Termination. If you violate any provision of these Terms, your authorization to access the Service and these Terms automatically terminate.

Non-Waiver. The failure to require performance of any provision will not affect our right to require performance at any other time after that, nor will a waiver by us of any breach or default of these Terms, or any provision of these Terms, be a waiver of any subsequent breach or default or a waiver of the provision itself. Use of section headers in these Terms is for convenience only and will not have any impact on the interpretation of any provision.

SECTION 8. MODIFICATIONS TO THE SERVICES AND PRICE

Modification of the Service. Canine Revolution reserves the right to modify or discontinue the Service at any time, temporarily or permanently. Prices for our Services are subject to change. Canine Revolution will have no liability for any change to the Service or any suspension or termination of your access to or use of the Service. 

We reserve the right, but are not obligated, to limit the Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

SECTION 9. DISCLAIMERS, NO WARRANTIES

THE SERVICE AND ALL MATERIALS AND CONTENT AVAILABLE THROUGH THE SERVICE ARE PROVIDED “AS IS” AND ON AN “AS AVAILABLE” BASIS. CANINE REVOLUSION DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, RELATING TO THE SERVICE AND ALL MATERIALS AND CONTENT AVAILABLE THROUGH THE SERVICE, INCLUDING: (A) ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, OR NON-INFRINGEMENT; AND (B) ANY WARRANTY ARISING OUT OF COURSE OF DEALING, USAGE, OR TRADE. CANINE REVOLUSION DOES NOT WARRANT THAT THE SERVICE OR ANY PORTION OF THE SERVICE, OR ANY MATERIALS OR CONTENT OFFERED THROUGH THE SERVICE, WILL BE UNINTERRUPTED, SECURE, OR FREE OF ERRORS, VIRUSES, OR OTHER HARMFUL COMPONENTS, AND CANINE REVOLUSION DOES NOT WARRANT THAT ANY OF THOSE ISSUES WILL BE CORRECTED.

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM THE SERVICE OR CANINE REVOLUSION ENTITIES OR ANY MATERIALS OR CONTENT AVAILABLE THROUGH THE SERVICE WILL CREATE ANY WARRANTY REGARDING ANY OF THE CANINE REVOLUSION ENTITIES OR THE SERVICE THAT IS NOT EXPRESSLY STATED IN THESE TERMS. WE ARE NOT RESPONSIBLE FOR ANY DAMAGE THAT MAY RESULT FROM THE SERVICE AND YOUR DEALING WITH ANY OTHER SERVICE USER. YOU UNDERSTAND AND AGREE THAT YOU USE ANY PORTION OF THE SERVICE AT YOUR OWN DISCRETION AND RISK, AND THAT WE ARE NOT RESPONSIBLE FOR ANY DAMAGE TO YOUR PROPERTY (INCLUDING YOUR COMPUTER SYSTEM OR MOBILE DEVICE USED IN CONNECTION WITH THE SERVICE) OR ANY LOSS OF DATA, INCLUDING USER CONTENT.

THE LIMITATIONS, EXCLUSIONS AND DISCLAIMERS IN THIS SECTION APPLY TO THE FULLEST EXTENT PERMITTED BY LAW. Canine Revolution does not disclaim any warranty or other right that Canine Revolution is prohibited from disclaiming under applicable law.

SECTION 10. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE CANINE REVOLUTION ENTITIES BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES (INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, OR ANY OTHER INTANGIBLE LOSS) ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR YOUR INABILITY TO ACCESS OR USE, THE SERVICE OR ANY MATERIALS OR CONTENT ON THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT ANY CANINE REVOLUTION ENTITY HAS BEEN INFORMED OF THE POSSIBILITY OF DAMAGE.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF THE CANINE REVOLUTION ENTITIES TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR ANY INABILITY TO USE ANY PORTION OF THE SERVICE OR OTHERWISE UNDER THESE TERMS, WHETHER IN CONTRACT, TORT, OR OTHERWISE, IS LIMITED TO THE GREATER OF: (A) THE AMOUNT YOU HAVE PAID TO CANINE REVOLUTION FOR ACCESS TO AND USE OF THE SERVICE IN THE 12 MONTHS PRIOR TO THE EVENT OR CIRCUMSTANCE GIVING RISE TO CLAIM; OR (B) $100.

EACH PROVISION OF THESE TERMS THAT PROVIDES FOR A LIMITATION OF LIABILITY, DISCLAIMER OF WARRANTIES, OR EXCLUSION OF DAMAGES IS INTENDED TO AND DOES ALLOCATE THE RISKS BETWEEN THE PARTIES UNDER THESE TERMS. THIS ALLOCATION IS AN ESSENTIAL ELEMENT OF THE BASIS OF THE BARGAIN BETWEEN THE PARTIES. EACH OF THESE PROVISIONS IS SEVERABLE AND INDEPENDENT OF ALL OTHER PROVISIONS OF THESE TERMS.

SECTION 11. PRIVACY POLICY

Our collection and use of your data and personal information in connection with the Service is as provided in our Privacy Policy located at https://www.caninerevolution.com/privacy-policy (“Privacy Policy”). Please read the Privacy Policy carefully for information relating to our collection, use, storage, disclosure of your personal information.

SECTION 12. ELIGIBILITY CRITERIA FOR DOGS

All dogs participating in our Services must meet the following eligibility requirements:
  • Age: Dogs must be at least 16-weeks-old at the start of training unless otherwise approved in writing by Canine Revolution Dog Training.
  • Vaccinations: All dogs must be up-to-date on core vaccinations including rabies, distemper, and parvovirus. Proof of current vaccinations is required prior to enrollment.
  • Health: Dogs must be in good overall health and free from contagious illnesses. If a dog is found to be ill or poses a health risk to others, training may be postponed or canceled with or without a refund.
  • Behavior: Dogs exhibiting extreme aggression or behaviors that may pose a risk to trainers, other dogs, or themselves may require an evaluation prior to acceptance. We reserve the right to decline or discontinue training if safety concerns arise.

SECTION 13. OWNER RESPONSIBILITIES

By enrolling in our Services, you agree to:
  • Provide accurate and complete information about your dog’s medical history, behavior, and temperament.
  • Inform Canine Revolution Dog Training of any changes in your dog’s behavior, health status, or environment that may affect training.
  • Ensure your dog arrives on time and in proper physical condition for all scheduled training sessions.
  • Follow through with any homework, reinforcement exercises, or behavioral management techniques recommended by the trainer.
  • Maintain your dog’s vaccination and health requirements throughout the duration of training.

SECTION 14. LIABILITY 

By enrolling in our training programs, you acknowledge and agree to the following:
  • Participation in dog training involves inherent risks, including but not limited to injury to your dog, yourself, or third parties.
  • You voluntarily assume all risks associated with training activities, including any potential harm to your dog or others.
  • You agree to hold harmless and release Canine Revolution Dog Training, its employees, agents, and contractors from any and all claims, liabilities, damages, or losses arising from your participation or your dog’s participation in training sessions, including off-site and in-home sessions.
  • You further agree to indemnify Canine Revolution Dog Training against any third-party claims arising from your dog’s behavior during or after training.

SECTION 15. EMERGENCY MEDICAL CARE

In the event that your dog becomes ill or injured during a training session and we are unable to reach you, you authorize Canine Revolution Dog Training to seek emergency veterinary care on your behalf. We will make every reasonable effort to contact you or your designated emergency contact before initiating care unless immediate treatment is necessary.

You agree to assume full financial responsibility for any veterinary services rendered.

Canine Revolution Dog Training will not be held liable for any outcomes related to emergency medical treatment, and you agree to release us from any associated liability.
